Distance sales agreement

1. Parties and subject

This agreement is made between the seller identified above and the buyer who places an order or loads wallet balance through the Swalk Club app.

Its subject is the sale and in-store handover of the products the buyer orders electronically through the app, and the loading of prepaid wallet balance.

The parties declare that they know and accept Law no. 6502 on Consumer Protection and the Distance Contracts Regulation.

2. Products and price

The essential characteristics of the products, the size options and the sale price are published on the menu page and in the Swalk Club app, and hold until the order is placed.

Prices are in Turkish lira and include value added tax. No separate delivery fee is charged.

The seller reserves the right to change published prices. The price that applies to the buyer is the one shown in the app at the moment the order is placed.

3. Prior information

Before confirming an order the buyer is informed in the app of the essential characteristics of the product, the total price including taxes, how it will be handed over, the seller's details, how the right of withdrawal works and how to make a complaint.

By confirming the order the buyer accepts having read that information and being placed under an obligation to pay.

4. Payment

Payment is made in the Swalk Club app by debit or credit card, or from wallet balance loaded earlier.

Card payments are taken through the infrastructure of PayTR Ödeme ve Elektronik Para Hizmetleri A.Ş. Card details are not passed to the seller and are not stored by the seller.

Any difference arising from instalments, extra instalments or deferrals applied by your bank is a matter between you and your bank.

5. Handover

The product is handed over at the store selected when ordering. There is no delivery to an address, by courier or by post.

6. Right of withdrawal

The buyer has a fourteen-day right of withdrawal under the Distance Contracts Regulation. That right does not apply in the cases listed in Article 15 of the same Regulation.

Drinks and food made to order and perishable in nature, and products whose packaging has been opened and which cannot be returned for hygiene reasons, fall within those exceptions.

7. Wallet balance

Wallet balance may be used only in Swalk Coffee stores and in the Swalk Club app. It cannot be transferred to another person or converted to cash.

A refund of unspent balance may be requested. Balance and SwalkCoin points granted under a promotion are outside this.

8. Personal data

The buyer's personal data is processed in accordance with Law no. 6698 on the Protection of Personal Data and related legislation. Details are on the Privacy and Data Protection page.

9. Disputes

Disputes arising from this agreement fall to the Consumer Arbitration Committees and Consumer Courts at the buyer's place of residence, within the monetary thresholds published each year by the Ministry of Trade.

10. Entry into force

By confirming an order the buyer is deemed to accept all the terms of this agreement, which takes effect on the date the order is confirmed.
